This website, japanderm.com, is operated by KIRAMEKI COMMERCE LLC, a Wyoming limited liability company doing business as Japan Derm. In these Terms of Service ("Terms"), "Japan Derm", "we", "us" and "our" mean KIRAMEKI COMMERCE LLC, and "you" means anyone who visits the website or buys from us.

By visiting our website or placing an order, you agree to these Terms and to the policies they refer to: our Shipping Policy, Refund Policy, Cancellation Policy and Privacy Policy. If you don't agree, please don't use the website or place an order.

Our store runs on Shopify, which provides the e-commerce platform we use to sell our products to you.

1. Who can buy

  • We sell to customers in the United States only. See our Shipping Policy for the addresses we deliver to.
  • You must be at least the age of majority in your state to place an order.
  • You agree to give us accurate, current and complete information when you order, and to keep your email address, payment method and shipping address up to date.

2. Our products

  • Our products are cosmetics for external use. They are not intended to diagnose, treat, cure or prevent any disease.
  • Read the full ingredient list before use. If you have sensitive skin or allergies, try the product on a small area of skin first. If you notice irritation, stop using the product. If you have a skin condition, are pregnant or are unsure, ask your doctor before use.
  • Individual results vary. Information on our website is for general information only and is not medical advice.
  • We try to show product colors, packaging and images as accurately as possible. Your screen may display them slightly differently, and packaging may change from time to time.

3. Prices and payment

  • All prices are in US dollars. The total you pay, including any applicable sales tax, is shown at checkout before you pay. Shipping on US orders is free.
  • Import duties and customs fees are included in the total you pay at checkout, as explained in our Shipping Policy.
  • Payments are processed by secure third-party payment providers. We do not store your full card details.
  • Card charges appear on your statement as JAPAN DERM.
  • Prices, offers and bundles may change at any time. A change never affects an order you have already placed. For subscriptions, see section 7.

4. Orders

  • Your order is an offer to buy. We accept it when we ship it. We send you an order confirmation email when you place it and a shipping confirmation with tracking when it ships.
  • If you give us a phone number with your order, you agree that we may call or text it about a week after delivery to follow up on that order: to check that it arrived, ask how it's going and what we could do better, and invite you to leave an honest review, good or bad. These calls use an artificial, AI-generated voice, not a live person, and never include offers. Giving us your phone number is optional. You can stop these calls at any time by telling us during the call, replying STOP to a text from us, or contacting support@japanderm.com or +1 (307) 677-9546. Our Privacy Policy has the details.
  • We may refuse or cancel an order, or limit quantities per person, household, payment method or address, including orders that appear to be placed by resellers or that we suspect are fraudulent. If we cancel an order after you have paid, we refund you in full.
  • If a product or price is shown in error, we may cancel the affected order and refund you in full, even after you have placed it. We will tell you by email.
  • Offers such as "buy one, get one free" apply to the bundle as shown at checkout. The free item is part of the bundle price you paid.

6. Cancellations, refunds and returns

Order cancellations, damaged or wrong items, our 90-day guarantee and refunds are covered by our Refund Policy: https://japanderm.com/policies/refund-policy

Because our products are cosmetics, we do not accept returns or give refunds for change of mind, except as described in that policy.

7. Subscriptions

Some products can be bought as a one-time purchase or as a subscription with automatic refills at a discount. Our Cancellation Policy has the full details and is part of these Terms: https://japanderm.com/policies/subscription-policy. In short:

  • The subscription option may be selected by default on the product page. You can switch to a one-time purchase before adding the product to your cart. If you subscribe, the checkout clearly shows that your order is a subscription, the subscription price and how often you will be charged, and you must agree to these terms to complete your order.
  • By subscribing, you authorize us to charge your payment method automatically at the subscription price and frequency shown at checkout, plus any applicable sales tax, until you cancel. Unless a different schedule is shown at checkout, your first renewal is 45 days after your first order and then every 30 days, with the same products and quantity. If you switch a one-time order to a subscription after purchase, your first renewal is 45 days after you switch, then every 30 days.
  • Each renewal is charged on the renewal date shown on the Manage Subscription page, to the payment method you used at checkout or the one you have updated since.
  • We email you a confirmation when you subscribe and a reminder at least 3 days before each renewal charge, with the amount, the date and a link to manage your subscription. Your next renewal date is always shown on the Manage Subscription page, linked in the footer of our website and in every subscription email.
  • You can cancel, skip a renewal or change your subscription at any time, online from the Manage Subscription page or by emailing support@japanderm.com. To stop or change the next renewal, do it at least 24 hours before its renewal date and time. There is no cancellation fee and no minimum number of orders.
  • If you forget to cancel, contact us within 12 hours of the renewal charge. If the order hasn't been sent for processing, we cancel it and refund you in full. After that, the renewal ships as usual and can't be refunded for change of mind, but we stop all future renewals. Renewals remain covered if they arrive damaged, defective, leaking, incomplete or wrong, or if they are late or lost.
  • Our 90-day guarantee applies to your first order only. It does not apply to subscription renewal orders.
  • If a renewal payment fails, we may retry it, and we may pause or cancel the subscription. We never ship a renewal until it has been paid.
  • If the subscription price changes, we email you in advance, before the new price takes effect, so you can cancel or change it first.

8. Reviews, comments and other content

  • If you send us reviews, photos, comments, ideas or other content, you allow us to use, edit, publish and share it in any medium, without payment to you. We will not publish your full name or contact details without your permission.
  • Your content must be truthful and must not be unlawful, offensive or misleading, or infringe anyone's rights. We may remove any content at our discretion.
  • If we offer you a free product, discount or other incentive in return for a review, we will say so wherever the review is shown.

9. Intellectual property

All content on this website, including text, images, videos, logos and design, belongs to us or our licensors. You may not copy, reproduce, resell or use it for commercial purposes without our written permission.

10. Third-party tools and links

Our website may include tools or links provided by third parties, such as payment providers, subscription management tools, shipping carriers and review platforms. We do not control them, and your use of them may also be governed by their own terms. We are not responsible for third-party websites we link to.

12. Prohibited uses

You may not use the website or its content: for any unlawful purpose; to give false information or place fraudulent orders; to infringe our rights or anyone else's; to harass or harm others; to upload viruses or malicious code; to collect other people's personal information; to spam, scrape or crawl the website; or to interfere with its security or operation. We may stop you from using the website if you break these rules.

13. Errors and availability

We try to keep the information on our website accurate and up to date, but it may occasionally contain errors in descriptions, prices, promotions, delivery times or availability. We may correct them at any time, as described in section 4. We may change, suspend or discontinue any part of the website or any product at any time.

14. Disclaimer

Except as expressly stated in these Terms and our policies, the website and our products are provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. This includes implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some states do not allow these exclusions, so they may not apply to you. Nothing in these Terms limits the remedies in our Shipping Policy, Refund Policy and Cancellation Policy.

15. Limitation of liability

To the fullest extent permitted by law, KIRAMEKI COMMERCE LLC and its members, managers, employees, agents, suppliers and service providers are not liable for any indirect, incidental, special, punitive or consequential damages, including lost profits, arising from your use of the website or our products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Some states do not allow these limitations, so in those states our liability is limited to the maximum extent the law allows.

16. Indemnification

You agree to indemnify and hold harmless KIRAMEKI COMMERCE LLC and its members, managers, employees, agents, suppliers and service providers from any third-party claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or the rights of others.

17. Resolving a problem

  • If you have a problem with an order, a charge or a subscription, please contact us first. Reach us any time, 24/7: email support@japanderm.com, or WhatsApp, text or call +1 (307) 677-9546. We can almost always solve it faster than a dispute with your bank or PayPal can.
  • If you don't recognize a charge, check your statement for JAPAN DERM and contact us before contacting your bank.
  • We cooperate with every bank and payment provider investigation and share the order, delivery and subscription records they ask for.

18. Governing law

These Terms, and any order or subscription you place with us, are governed by the laws of the State of Wyoming and applicable US federal law, without regard to conflict of law rules. Nothing in these Terms takes away any right you have under the consumer protection laws of the state where you live.

19. Severability, waiver and entire agreement

  • If any part of these Terms is found unenforceable, that part will be enforced to the maximum extent allowed and the rest of the Terms will remain in effect.
  • If we don't enforce a right or provision, that is not a waiver of it.
  • These Terms and the policies they refer to are the entire agreement between you and us about the website and your orders, and replace any earlier versions.

20. Termination

These Terms apply until ended by you or us. You can end them by no longer using the website and cancelling any active subscription. We may end them, or refuse service, if you break these Terms. Obligations that arose before termination, including payment for orders already shipped and our obligations under our policies, remain in effect.

21. Changes to these Terms

We may update these Terms from time to time. The current version is always on this page, with the date of the last update at the top. Changes apply from the date they are posted and do not affect orders placed before that date. We will email active subscribers about any change that affects their subscription before it applies to their next renewal.
